Article 249
Functions, Duties and Powers of the National Human Rights Commission
(1) It shall be the duty of the National Human Rights Commission to ensure the respect, protection and promotion of human rights and their effective implementation.
(2) In order to fulfill the duties mentioned in sub-section (1), the National Human Rights Commission shall do the following:-
(a) In respect of human rights violation of any person or group or the aggravation thereof, the petition or complaint submitted or sent to the Commission by the victim himself or on his behalf, or the matter received by the Commission from any source or brought to the knowledge of the Commission, after investigating and recommending action against the culprits ,
(b) If the official who has the responsibility or duty to prevent the violation of human rights does not fulfill his responsibility or does not fulfill his duty or shows indifference to fulfill his responsibility or fulfill his duty, to recommend to the relevant authority to take departmental action against such official,
(c) If there is a need to file a case against a person or organization that violates human rights, to recommend filing a case in court according to the law,
(d) Coordinate and collaborate with civil society to increase awareness of human rights,
(e) Recommending to the relevant authorities the reason and basis for departmental action and punishment against human rights violators,
(f) Periodically reviewing the laws related to human rights and making recommendations to the Government of Nepal regarding the reforms and amendments to be made therein,
(g) If Nepal should become a party to an international treaty or agreement related to human rights, to recommend to the Government of Nepal with the reasons thereof and to monitor the implementation of the treaty or agreement to which Nepal has become a party, and if it is found to be non-implementation, to recommend to the Government of Nepal for its implementation,
(h) The names of the officials, persons or bodies who do not follow or implement the recommendations or instructions given by the National Human Rights Commission in relation to the violation of human rights shall be made public in accordance with the law.Record as an infringer.
(3) The Human Rights Commission may exercise the following powers while performing its functions or performing its duties:-
(a) To bring any person before the Commission to take information or statement or to make a statement, to hear evidence, to make him file any evidence, to exercise the same powers as the court has,
(b) If the commission receives any information that a serious violation of human rights has occurred or has occurred, enter any person or his residence or office without notice, conduct a search, and while conducting such a search, seize documents, evidence or evidence related to the violation of human rights,
(c) Entering and rescuing a government office or other place without notice if it is necessary to take immediate action after knowing that a person's human rights are being violated,
(d) To order compensation according to the law to the victims of violation of human rights.
(4) The National Human Rights Commission may delegate any of its functions, duties and powers to the chairman of the commission, a member or an employee of the Government of Nepal, subject to the prescribed conditions.
(5) Other functions, duties and rights and procedures of the National Human Rights Commission shall be in accordance with the federal law.
